The enactment of this Bill paves the way for immediate and future improvements to the NDIS, focusing on streamlining processes and enhancing the NDIS participant experience. In the weeks to come, as the new NDIS laws take effect, there will be some adjustments to how the Scheme operates. However, until these new provisions are formally implemented:

  1. Current procedures remain unchanged: All access and planning processes, decisions, and supports will continue to follow the existing operational guidance.
  2. Participants should continue as usual: It’s important for participants to continue utilizing their funds according to their current plans.
  3. Providers should proceed accordingly: Providers should claim for support as they have been, adhering to the current rules.

These changes are structured around new NDIS Rules, which will outline how the Scheme functions. Importantly, these Rules will be developed in partnership with the disability community, reinforcing the central role of individuals with disabilities in shaping the NDIS reforms.

Timing of New NDIS Laws

As the community prepares for these adjustments, it is essential to note that the new laws will take effect 28 days after receiving Royal Assent, which the NDIS anticipates will be in mid to late September. For participants, there may be several changes to how the NDIS functions:

  • Eligibility Assessments: New methods for assessing eligibility will be introduced to ensure that support is provided to those who need it most.

  • Plan Management: Changes may be introduced in how participant plans are structured and managed.
  • Funding Allocation: The allocation and spending of funds might be revised to better align with individual needs and ensure equitable distribution.

  • Section 30 – Revocation of Participant Status: If a participant is under review and fails to provide the requested information within a reasonable time, the NDIA may revoke their access to the Scheme, ensuring resources are reserved for those meeting the eligibility criteria.
